Terms of Use
Version 1.6 | Last Updated: October 27, 2026
Overview
The website located at tuxedodrive.com (the “Site”) is a copyrighted work belonging to Tuxedo Drive (“Company”, “us”, “our”, and “we”).
Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into these Terms.
Agreement to Terms
These Terms of Use (these “Terms”) set forth the legally binding terms and conditions that govern your use of the Site. By accessing or using the Site, you are accepting these Terms (on behalf of yourself or the entity that you represent), and you represent and warrant that you have the right, authority, and capacity to enter into these Terms.
You may not access or use the Site or accept the Terms if you are not at least 18 years old. If you do not agree with all of the provisions of these Terms, do not access and/or use the Site.
⚠️ Important Notice: Dispute Resolution
PLEASE BE AWARE THAT SECTION 8 CONTAINS PROVISIONS GOVERNING HOW TO RESOLVE DISPUTES BETWEEN YOU AND COMPANY.
Among other things, Section 8 includes an agreement to arbitrate which requires, with limited exceptions, that all disputes between you and us shall be resolved by binding and final arbitration. Section 8 also contains a class action and jury trial waiver.
What This Means
Unless you opt out of the agreement to arbitrate within 30 days:
- You will only be permitted to pursue disputes or claims against us on an individual basis, not as a plaintiff or class member in any class or representative action
- You are waiving your right to pursue disputes in a court of law and to have a jury trial
1. Accounts
Account Creation
In order to use certain features of the Site, you must register for an account (“Account”) and provide certain information about yourself as prompted by the account registration form.
You represent and warrant that:
- All required registration information you submit is truthful and accurate
- You will maintain the accuracy of such information
You may delete your Account at any time, for any reason, by following the instructions on the Site. Company may suspend or terminate your Account in accordance with Section 7.
Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your Account login information
- All activities that occur under your Account
- Immediately notifying Company of any unauthorized use or suspected unauthorized use of your Account
Company cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
2. Access to the Site
License
Subject to these Terms, Company grants you a non-transferable, non-exclusive, revocable, limited license to access and use the Site and the Services:
- As a motorist or member — to buy washes, enroll in and manage a membership, and manage your account with a participating car wash business.
- As a car wash business — including its owners, operators, employees, and other authorized users — to operate that business’s car wash locations, including managing memberships, billing, customers, staff, marketing, and reporting.
Use by a car wash business and its authorized users is also governed by the Tuxedo Drive Master Services Agreement between Company and that business. Where these Terms and that agreement conflict as to that use, the Master Services Agreement controls. Each authorized user remains individually bound by these Terms, including the Prohibited Conduct, Ownership, Disclaimers, Limitation on Liability, and Dispute Resolution provisions, and the business is responsible for its authorized users’ compliance.
This license does not permit you to resell, sublicense, or provide access to the Site or the Services to anyone else, or to use them to operate a business other than a car wash business that has its own agreement with Company.
Restrictions
The rights granted to you in these Terms are subject to the following restrictions:
- You shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site
- You shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site
- You shall not access the Site in order to build a similar or competitive website, product, or service
- No part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, except as expressly stated herein
All copyright and other proprietary notices on the Site (or on any content displayed on the Site) must be retained on all copies thereof.
Prohibited Conduct
In addition to the restrictions above, you agree that you will not:
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Register or use an account under a false name, or submit false or misleading information
- Use any robot, spider, crawler, scraper, script, or other automated means to access, monitor, index, or copy any part of the Site, or to extract data from it, including license plate data, vehicle records, membership records, pricing, or operational data
- Harvest or collect e-mail addresses, phone numbers, or other contact or personal information of any Site user
- Attempt to gain unauthorized access to any account, computer system, or network connected to the Site, or bypass, disable, or otherwise interfere with any security or authentication feature of the Site
- Take any action that imposes an unreasonable load on the Site’s infrastructure, including flooding, denial-of-service activity, or sending mass unsolicited messages through the Site
- Introduce any virus, malware, or other code intended to damage, disrupt, or gain unauthorized access to the Site or to any user’s data
- Use the Site in violation of any applicable law, rule, regulation, or order
We may investigate any suspected violation of this section and cooperate with law enforcement in doing so.
Modification
Company reserves the right, at any time, to modify, suspend, or discontinue the Site (in whole or in part) with or without notice to you. You agree that Company will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Site or any part thereof.
No Support or Maintenance
You acknowledge and agree that Company will have no obligation to provide you with any support or maintenance in connection with the Site.
Ownership
You acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Site and its content are owned by Company or Company’s suppliers.
Neither these Terms (nor your access to the Site) transfers to you or any third party any rights, title or interest in or to such intellectual property rights, except for the limited access rights expressly set forth in this section. Company and its suppliers reserve all rights not granted in these Terms.
Copyright Complaints
Company respects the intellectual property rights of others and responds to notices of claimed copyright infringement under the Digital Millennium Copyright Act.
If you believe that material available on or through the Site infringes a copyright you own or control, send a written notice to our designated agent containing all of the following:
- Your name, mailing address, telephone number, and e-mail address
- Identification of the copyrighted work you claim has been infringed
- Identification of the material you claim is infringing and enough information to let us locate it on the Site
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
- Your physical or electronic signature
Designated agent: Copyright Agent, Tuxedo Drive 2955 Shell Road, Brooklyn, New York 11224 Email: privacy@tuxedodrive.com
We will remove or disable access to material that is the subject of a valid notice, and we may terminate the accounts of users we determine to be repeat infringers. If you believe material was removed in error, you may send a counter-notice to the same address.
Feedback
If you provide Company with any feedback or suggestions regarding the Site (“Feedback”), you hereby assign to Company all rights in such Feedback and agree that Company shall have the right to use and fully exploit such Feedback and related information in any manner it deems appropriate.
Company will treat any Feedback you provide to Company as non-confidential and non-proprietary.
User Content
Certain features of the Site may let you submit content — for example, reviews, ratings, comments, photographs, or vehicle images (“User Content”). You retain ownership of your User Content. By submitting it, you grant Company and the participating car wash location a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, translate, publish, and display that User Content in connection with operating and promoting the Site and the car wash location’s services.
You represent and warrant that you own or have the necessary rights to the User Content you submit, and that it does not violate any law or infringe the rights of any person or entity.
Do not send us confidential or proprietary information. Any User Content you submit is treated as non-confidential.
Monitoring
Company has the right, but not the obligation, to monitor, review, refuse, edit, or remove any User Content, in whole or in part, at its sole discretion — including content we determine is objectionable, unlawful, or in violation of these Terms. Company is not responsible for User Content submitted by any user. We may also disclose any information as necessary to comply with any law, regulation, legal process, or governmental request.
We may impose limits on features of the Site, or restrict your access to part or all of the Site, without notice or liability, if we believe you are in breach of these Terms or applicable law.
3. Indemnification
You agree to indemnify and hold Company (and its officers, employees, and agents, and any participating car wash location) harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of:
- Your use of the Site, the Services, a membership, or a car wash location
- Your violation of these Terms, the Tuxedo Drive Car Wash Customer Terms, or a car wash location’s own posted terms
- Your violation of applicable laws or regulations
- Your conduct on a car wash location’s property, and any damage you or your vehicle cause there
Company reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.
4. Third-Party Links & Other Users
Third-Party Links & Ads
The Site may contain links to third-party websites and services, and/or display advertisements for third parties (collectively, “Third-Party Links & Ads”).
Important:
- Third-Party Links & Ads are not under Company’s control
- Company does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links & Ads
- You use all Third-Party Links & Ads at your own risk
When you click on any Third-Party Links & Ads, the applicable third party’s terms and policies apply, including their privacy and data gathering practices.
Platform Only — Car Wash Services
Company is a software platform provider. It is not a car wash operator and is not a party to any agreement between you and a participating car wash location. Car wash services, membership plans, pricing, and facility operations are provided by independently owned and operated car wash businesses that use the Tuxedo Drive platform under a separate business agreement with Company.
Company facilitates membership enrollment, billing, and account management on behalf of participating car wash locations. This does not make Company a party to the service relationship between you and the car wash location, and Company is not responsible for the acts, omissions, or conduct of any car wash location. Any disputes regarding wash services, equipment, or membership benefits should be directed to the participating car wash location.
Participating car wash locations are intended third-party beneficiaries of these Terms, including the indemnification provision in Section 3 and the disclaimers, limitation of liability, release, and arbitration provisions in Sections 4 through 8, and may enforce those provisions directly. Nothing in these Terms limits a participating car wash location’s liability for its own negligence, gross negligence, or intentional misconduct, or any liability that applicable law does not allow to be limited; the Tuxedo Drive Car Wash Customer Terms say more about a location’s responsibility.
Prices may differ by payment method and by customer. A participating car wash location may post two prices: a cash/debit price for paying by cash or debit card, and a higher credit price for paying by credit card. Paying by credit card means paying the posted credit price, and nothing is added to it. The credit price is not a surcharge or fee for using a credit card. Your receipt shows the price you paid. You are charged the price for the payment method you identify before you pay: at a staffed lane the attendant enters the payment method you name, and online or at a self-service screen you choose it yourself. If a card identified as a debit card is processed as a credit card, the location may require the posted credit price or another payment method, to the extent permitted by applicable law. A location may also offer different prices or discounts based on characteristics of your vehicle or purchase that it chooses to reward, such as displaying a sponsor’s or local sports team’s bumper sticker, but never based on a characteristic protected by federal, state, or local anti-discrimination law. See the Tuxedo Drive Car Wash Customer Terms for how this applies to single washes, memberships, and fleets.
Car wash locations may have their own terms. A participating car wash location may post or publish its own rules, policies, terms, or conditions — at its facility, on its own website, on signage, on a receipt, or in its marketing materials and promotional offers — which apply to you in addition to these Terms. Company does not write, review, approve, or monitor those terms, does not adopt them, and is not responsible for them or for their enforcement. Where a location’s own terms conflict with these Terms or the Tuxedo Drive Car Wash Customer Terms on a matter handled by the Tuxedo Drive platform, these Terms and the Car Wash Customer Terms control as to Company.
Refunds and Returns
Returns, refunds, and gift card and prepaid wash credit terms for purchases from a participating car wash location are set out in the Tuxedo Drive Car Wash Customer Terms. Company is not a party to any return, refund, or settlement and is not responsible for a location’s decision to accept or decline one. Nothing in this section limits any right you have under applicable law.
Business Service Integrations
If you are a car wash location owner or operator, the Site may offer optional features that configure or manage services with a third-party business service provider on your behalf — for example, an advertising or accounting platform — whether by connecting an account you control or by acting on your behalf using business information you supply. Company does not guarantee any level of performance, results, or return from these services, and is not responsible for the availability, decisions, policies, or actions of any third-party provider, including suspension or termination of an account or campaign. Your relationship with that third-party provider, where you connect an account of your own, is governed by that provider’s own terms.
Other Users
Your interactions with other Site users are solely between you and such users. You agree that Company will not be responsible for any loss or damage incurred as the result of any such interactions.
Release
You hereby release and forever discharge Company (and our officers, employees, agents, successors, and assigns) from each and every past, present and future dispute, claim, controversy, demand, right, obligation, liability, action and cause of action that has arisen or arises directly or indirectly out of, or that relates directly or indirectly to:
- The Site
- Any interactions with other Site users
- Any Third-Party Links & Ads
California Residents: You hereby waive California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release.”
5. Disclaimers
THE SITE IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS.
Company (and our suppliers) expressly disclaim any and all warranties and conditions of any kind, whether express, implied, or statutory, including:
- Warranties of MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- TITLE
- QUIET ENJOYMENT
- ACCURACY
- NON-INFRINGEMENT
We make no warranty that the Site will:
- Meet your requirements
- Be available on an uninterrupted, timely, secure, or error-free basis
- Be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe
Some features of the Site use artificial intelligence, including generative AI, to produce content such as suggested marketing copy on behalf of a car wash location. AI-generated content may be inaccurate or unsuitable for its intended use, and is not reviewed by Company for accuracy before it reaches you. A car wash location that uses such content is responsible for reviewing it before use.
If applicable law requires any warranties with respect to the Site, all such warranties are limited in duration to 90 days from the date of first use.
Note: Some jurisdictions do not allow the exclusion of implied warranties or limitations on how long an implied warranty lasts, so the above exclusions may not apply to you.
6. Limitation on Liability
Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY (OR OUR SUPPLIERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR:
- Lost profits or lost data
- Costs of procurement of substitute products
- Any indirect, consequential, exemplary, incidental, special or punitive damages
This applies even if Company has been advised of the possibility of such damages.
Access to and use of the Site is at your own discretion and risk. You will be solely responsible for any damage to your device or computer system, or loss of data resulting therefrom.
Damage Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, our liability to you for any damages arising from or related to these Terms will at all times be limited to a maximum of fifty US dollars ($50).
The existence of more than one claim will not enlarge this limit.
Note: Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
7. Term and Termination
Subject to this Section, these Terms will remain in full force and effect while you use the Site.
Termination Rights
We may suspend or terminate your rights to use the Site (including your Account) at any time for any reason at our sole discretion, including for any use of the Site in violation of these Terms.
Refusal of Service and Bans
We reserve the right to refuse service to anyone, and to suspend, restrict, ban, or permanently terminate any user’s access to the Site, an Account, or the Services — in whole or in part, with or without prior notice, and at our sole discretion. Where a ban affects a membership, you are notified as described in the Tuxedo Drive Car Wash Customer Terms.
We may do this for conduct that violates these Terms or applicable law, for fraud, abuse, or chargeback abuse, for threatening or abusive behavior toward our personnel or toward a participating car wash location’s personnel or customers, to protect the security or integrity of the Site, or where we reasonably believe it is necessary to protect Company, a participating car wash location, or another user.
A ban may apply to a single Account, to any Account we associate with you, to a device or payment method, or to a vehicle identified only by its license plate where no account or identity is known. We may also decline to provide the Services to you in the future. Participating car wash locations may separately refuse service or bar a person or vehicle from their property, and nothing in these Terms limits that right.
Where a car wash location bans a person or vehicle for cause, that ban applies across every location that business operates. A ban is not shared with other car wash businesses on the platform. If you believe a ban is a mistake, contact the business that imposed it or email privacy@tuxedodrive.com.
Where your membership is affected, the consequences of a ban — cancellation without refund — are described in the Tuxedo Drive Car Wash Customer Terms.
We are not obligated to give a reason, and we will have no liability to you for any refusal, suspension, restriction, or ban. Any amounts already due remain payable.
Upon termination:
- Your Account and right to access and use the Site will terminate immediately
- Company will not have any liability whatsoever to you for termination
Survival
Even after termination, certain provisions of these Terms will remain in effect, including the Restrictions, Prohibited Conduct, Ownership, Feedback, User Content, and Monitoring provisions of Section 2, and Sections 3 through 9 in their entirety.
8. Dispute Resolution & Arbitration
Changes to Terms
These Terms are subject to occasional revision. If we make any substantial changes, we may notify you by:
- Sending an e-mail to the last e-mail address you provided to us
- Prominently posting notice of the changes on our Site
You are responsible for providing us with your most current e-mail address. Continued use of our Site following notice of changes indicates your acknowledgement and agreement to be bound by such changes.
Arbitration Agreement
Please read this arbitration agreement carefully. It requires you to arbitrate disputes with Company and limits the manner in which you can seek relief.
Applicability
You agree that any dispute between you and Company relating to the Site, the Services, or these Terms will be resolved by binding arbitration, rather than in court, except that:
- You and Company may assert individualized claims in small claims court if the claims qualify
- You or Company may seek equitable relief in court for infringement or other misuse of intellectual property rights
This Arbitration Agreement survives the expiration or termination of these Terms.
Who Is Covered
This Arbitration Agreement applies to you and to anyone who uses the Site, an Account, or a membership through you — including any person you authorize to drive a vehicle enrolled in a membership associated with your Account. It also applies for the benefit of participating car wash locations, which are intended third-party beneficiaries of this Arbitration Agreement and may invoke and enforce it.
Informal Dispute Resolution
Before commencing arbitration, you and Company agree to first participate in a good faith Informal Dispute Resolution Conference (telephonically or via videoconference).
To initiate: Send written notice to privacy@tuxedodrive.com or to 2955 Shell Road, Brooklyn, New York 11224
Notice must include:
- Your name, telephone number, mailing address, e-mail address
- Your counsel’s information (if represented)
- A description of your Dispute
The conference must occur within 45 days after the other party receives notice. This is a required condition precedent to arbitration.
Arbitration Rules and Forum
If informal resolution fails within 60 days, either party may initiate binding arbitration administered by JAMS, Inc. (formerly Judicial Arbitration and Mediation Services, Inc.), a private alternative dispute resolution provider. Information about JAMS, its rules, its fee schedule, and how to begin a case is at jamsadr.com, or by calling JAMS at 1-800-352-5267.
Applicable rules:
- Disputes under $250,000: JAMS Streamlined Arbitration Rules
- All other claims: JAMS Comprehensive Arbitration Rules
Where the rules conflict with these Terms, these Terms control, except that the JAMS Consumer Arbitration Minimum Standards control over any conflicting provision of these Terms.
Consumer Arbitration Minimum Standards. Where you are a consumer, this Arbitration Agreement is subject to the JAMS Consumer Arbitration Minimum Standards, which are incorporated by reference. Among other things, those standards limit the fees a consumer can be required to pay and require that the arbitration be reasonably accessible to the consumer.
Fees. Where you are a consumer, you are responsible only for the initial case-filing fee the JAMS Consumer Arbitration Minimum Standards permit JAMS to charge a consumer, and Company will pay all other JAMS administrative and arbitrator fees. If you demonstrate that the filing fee would be a hardship, Company will pay it. This does not affect an arbitrator’s authority to allocate fees where a claim or defense is found frivolous or brought for an improper purpose.
Location. The arbitration will be conducted in the county where you reside, unless otherwise agreed. You may elect for the arbitration to be conducted by telephone, by videoconference, or on written submissions only.
If JAMS is unavailable. If JAMS is unable or unwilling to administer the arbitration under these Terms, the parties will agree on a substitute administrator that will administer it consistent with these Terms. If the parties cannot agree within 30 days, either party may ask a court of competent jurisdiction in the forum identified in Section 9 to appoint one. A substitute administrator’s appointment does not revive any waived right to a court or jury trial.
Coordinated Filings
If 25 or more demands for arbitration raising substantially similar claims are filed against Company by or with the assistance of the same law firm or coordinated group of law firms, those demands will be treated as a coordinated filing and administered in sequential batches of no more than 50 demands at a time.
The parties will work with JAMS to select the demands in each batch, and JAMS will treat only the demands in the current batch as filed for purposes of assessing fees. Applicable statutes of limitation and filing deadlines are tolled for all demands in a coordinated filing while the batching process proceeds.
After two batches have been resolved, either party may request a global mediation of the remaining demands. If that mediation does not resolve them, the remaining demands proceed in subsequent batches.
A court has authority to enforce this batching procedure and to enjoin the filing or administration of demands that do not comply with it. This provision is intended to make arbitration efficient for both sides and does not restrict the relief available to any individual claimant.
Time Limit for Claims
To the fullest extent permitted by applicable law, any claim arising out of or relating to these Terms, the Site, or the Services must be brought within one (1) year after the claim accrues. A claim not brought within that period is permanently barred. This limitation does not apply where applicable law prohibits it.
Waiver of Jury Trial
YOU AND COMPANY HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.
An arbitrator can award the same damages and relief as a court. However, there is no judge or jury in arbitration, and court review of an arbitration award is very limited.
Waiver of Class Action
YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, REPRESENTATIVE, OR COLLECTIVE BASIS.
Only individual relief is available. Disputes of more than one customer or user cannot be arbitrated or consolidated.
30-Day Right to Opt Out
You have the right to opt out of this Arbitration Agreement by sending written notice within 30 days after first becoming subject to these Terms.
Send opt-out notice to:
- Email: privacy@tuxedodrive.com
- Mail: 2955 Shell Road, Brooklyn, New York 11224
Your notice must include your name and address and a clear statement that you want to opt out of this Arbitration Agreement.
If you opt out, all other parts of these Terms will continue to apply to you.
Severability of This Arbitration Agreement
If any part of this Arbitration Agreement is found unenforceable, that part will be severed and the remainder will continue to apply — except that if the Waiver of Class Action is found unenforceable as to any claim or request for relief, then that claim or request for relief will be severed and proceed in court under the Forum Selection provision in Section 9, and the remaining claims will proceed in arbitration. If the Waiver of Class Action is found unenforceable in its entirety, this Arbitration Agreement (other than the Waiver of Jury Trial and the Informal Dispute Resolution requirement) is void.
9. General Provisions
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. This choice of law does not deprive you of any protection under a mandatory consumer-protection law of the state or locality where you reside that cannot be waived by agreement.
Forum Selection
For any claim that is not subject to arbitration under Section 8 — including a claim brought after a valid opt-out, a claim severed from arbitration, or an action to enforce or vacate an arbitration award — the exclusive forum is the state and federal courts located in the State of Delaware. You and Company each consent to the personal jurisdiction and venue of those courts. This does not affect either party’s right to bring a qualifying individual claim in small claims court.
Governing Language
These Terms are written and executed in English. If we make a translation available for convenience, the English version controls in the event of any conflict or difference in meaning, and all proceedings relating to these Terms will be conducted in English.
Geographic Scope
Company controls and operates the Site from the United States. We make no representation that the Site or its content is appropriate or available for use outside the United States. If you access the Site from elsewhere, you do so on your own initiative and are responsible for compliance with local law.
Force Majeure
Company is not liable for any delay or failure to perform caused by an event beyond its reasonable control, including acts of God, severe weather, fire, flood, earthquake, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, government order, utility or telecommunications failure, or the failure of a third-party payment processor, carrier, or hosting provider.
Notices
Notices to you may be given by email to the address on file for your Account or by posting on the Site. Notices to Company must be sent to privacy@tuxedodrive.com and to 2955 Shell Road, Brooklyn, New York 11224. You are responsible for keeping your contact information current.
Export
The Site may be subject to U.S. export control laws. You agree not to export, reexport, or transfer, directly or indirectly, any U.S. technical data acquired from Company in violation of United States export laws or regulations.
Disclosures
Company is located at 2955 Shell Road, Brooklyn, New York 11224.
California residents: You may report complaints to the Complaint Assistance Unit of the Division of Consumer Product of the California Department of Consumer Affairs by contacting them in writing at 400 R Street, Sacramento, CA 95814, or by telephone at (800) 952-5210.
Accessibility
Company designs the Site and the Services to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, and we treat conformance as an ongoing obligation rather than a one-time exercise. Parts of the Site, third-party content, and content supplied by a car wash business may not yet fully conform.
If you encounter an accessibility barrier, or need information or a transaction provided in an alternative format, contact us at privacy@tuxedodrive.com with a description of the barrier and the page or feature involved. We will respond and work with you to provide the information or complete the transaction through an accessible alternative.
Physical car wash facilities are owned and operated by independent businesses, which are responsible for the accessibility of their own premises.
Electronic Communications
The communications between you and Company use electronic means. For contractual purposes, you:
- Consent to receive communications from Company in electronic form
- Agree that all terms, agreements, notices, and disclosures that Company provides electronically satisfy any legal requirement for hardcopy writing
Entire Agreement
These Terms constitute the entire agreement between you and Company regarding use of the Site, and incorporate by reference any supplemental terms applicable to specific features or services, including the Tuxedo Drive Car Wash Customer Terms for members enrolled in a vehicle wash membership plan.
Key points:
- Our failure to enforce any provision does not waive that provision
- If any provision is invalid, it will be modified to the minimum extent necessary to be enforceable, or severed, and the other provisions remain in effect
- You may not assign these Terms without our prior written consent
- Company may freely assign these Terms
- These Terms will not be construed against either party as the drafter
